Terms and Conditions

 

Welcome to WillowPawArt. These Terms and Conditions ("Terms") govern your access to and use of our website, willowpawart.com (the "Site"), and the purchase of any custom art products ("Products") from us. By using our Site or placing an order, you agree to be bound by these Terms.

 

WillowPawArt is a brand operated by BOREDOM BUSTER LTD ("we", "us", "our"), a company registered in England and Wales.

 

Eligibility: To purchase from us, you must be at least 18 years old or the age of legal majority in your jurisdiction.

Contract formation: A binding contract is formed when you place an order on our Site. We reserve the right to refuse or cancel any order at our discretion, for reasons including product availability, errors in pricing, or suspected fraudulent activity. If we cancel an order after you have paid, a full refund will be issued.

Order cancellation and refunds: Because every Product is custom-made, your cancellation rights follow the stage of your order:

Account security: You are responsible for maintaining the confidentiality of your account information.

 

Customer-provided content: By uploading a photograph or other content ("User Content") to our Site, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and adapt your User Content for the purpose of creating and fulfilling your custom order. We will only feature your pet or photos in our marketing with your separate permission.

Your representations: You represent and warrant that you own all rights to the User Content or have obtained all necessary permissions to grant us this license. You agree to indemnify us for any claims arising from a breach of this warranty.

Our intellectual property: All content on this Site — including text, graphics, logos, and the artwork and designs we create (excluding your User Content) — is the property of BOREDOM BUSTER LTD and is protected by intellectual property laws. When you buy a physical Product, you own that physical item. When you buy a Digital Portrait, you receive a personal-use license to print and enjoy the file for yourself and as gifts — it may not be resold, shared commercially, or used in products for sale.

 

Currency: Prices are displayed in the local currency of the region you are browsing from, where possible. Your final total, including any tax we are required to collect, is clearly stated at checkout.

Pricing: Prices are as displayed at checkout. In the rare event of a pricing error, we will contact you before processing your order or cancel and refund in full.

Taxes and duties: Prices are displayed exclusive of applicable taxes. For orders delivered to the United Kingdom with a total value of £135 or less, and to the European Union with a total value of €150 or less, we are required by law to collect the applicable VAT at checkout, and it will be included in the price you pay. For orders above these thresholds, and for deliveries to other countries, customs duties, import taxes, and customs handling fees may be charged by your local customs authority upon delivery. These charges are your responsibility, are not included in our product prices or shipping costs, and we cannot predict their amount.

 

No change-of-mind returns after production begins: Due to the personalized nature of our Products, we can't accept returns or offer change-of-mind refunds once production has begun. Before you approve your artwork, however, revisions are unlimited and a full refund is always available.

Damaged or incorrect items: If your Product arrives damaged, defective, incorrect, or materially different from the artwork you approved, contact support@willowpawart.com within 30 days of delivery with your order number and photographic evidence. If the issue is confirmed to be ours, we'll remake it free of charge; if a remake isn't possible or can't fix the problem, you'll receive a full refund — including original shipping and expedited fees where the issue is our fault.

Digital products: Digital portraits are fully refundable until the final high-resolution file is delivered. Once the file has been emailed, digital orders are non-refundable, as the file can't be returned.

Your purchase may be subject to mandatory local consumer protection laws. Nothing in these Terms limits those rights.

For consumers in Canada: You may be entitled to rights and remedies under the consumer protection legislation of your province or territory. Residents of Quebec: these Terms are governed by the laws of Quebec and disputes are subject to the jurisdiction of the courts of Quebec.

For consumers in Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality.

 

To the fullest extent permitted by law, our liability for any claim arising out of your purchase is limited to the amount you paid for the Product. We're not liable for indirect, incidental, special, or consequential damages. This doesn't limit our liability for death or personal injury caused by our negligence, fraud, or any matter for which it would be illegal to exclude liability — and it doesn't limit your statutory consumer rights.

 

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. You benefit from any mandatory provisions of the law of your country of residence. Disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales.
